Good to know about Swiss trademark!

Following up on our newsletter from last week. Here we have some interesting points about Swiss trademark for you. 

- The company name is not automatically protected as a trade mark. The name of a company, once registered, is secured in commercial registry. This means that other people cannot register a company with the same name. However, to protect the chosen name as a trademark, it needs to meet the requirements for protection and register as a trademark. 

- It is not obligated to use the ® symbol. With or without the trademark symbol (®), there is no difference to the rights of the trade mark owner in Switzerland. However, the benefit of the symbol is that it can alert other people that the trademark is registered and can prevent infringement cases.
